These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors a full range of organic apparel and garments for babies, children and women. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.
Who can use your website, what are the requirements to create an account:
In order to use our website and/or receive our services, you must be of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
Key commercial terms offered to customers:
When buying an item at our online store, you agree that:
(i) You are responsible for reading the full item listing before making a commitment to buy it.
(ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. The fees for the services and any other charges you may incur in connection with the purchase of our products, such as taxes and shipment fees, depend on many things, such as the total price, or the weight of the items and the destination of the shipment, and will be indicated at the time you are placing your order.
Returns and refund policy:
For any undamaged, unused and unstained product, simply return it to our address with its original tags and packaging along with the original purchase receipt (or gift receipt) within 14 days of the date you receive the product, and we will exchange it or offer a refund based upon the original payment method. We will no issue a refund for items which we believe that have been worn or used, which are stained, torn or damaged in any way, or which are returned after 14 days of being received by you. Our decision herein is made at our sole discretion and it is final. Any arbitration or claim dispute therein will have to be brought in front of the Courts of Miami-Dade County, Florida.
What items are returnable? • Full price items within 14 days of receipt of your shipment (Returns must be received by our warehouse within 14 days) • In original condition • Unwashed, Unworn, undamaged and untorn • In the original packaging with original unbroken hang tags.
What items are non-refundable? • Sale items discounted more than 20% off are considered final sale and are not eligible for return or exchange. • International orders are not eligible for return or exchanges.
Are there any charges for return? • A $3.50 per return + $.50 per item restocking fee applies if the entire order is returned. The restocking fee is waived if you keep at least one item in your order. • Original shipping charges is non-refundable • Customers are responsible for return shipping charges except for damaged items or wrong items sent.
Retention of right to change offering:
We may, without prior notice, change the services/products; stop providing the services or products, or any features of the services/products we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services/products without notice and liability for any reason, or for no reason.
Warranties & responsibility for services and products:
When we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us. We will pay for shipment of repaired or replaced products to customer and customer will be responsible for return shipment of the product to us.
Ownership of intellectual property, copyrights and logos:
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Ibertex LLC, doing business as NAPAANI ORGANIC. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
If you want to offer to your users the ability to upload content (images, audio, text ...) for disclosure on your site, it is important that the issuer of such content certifies that he has all the legal rights and/or necessary licenses over the content and that such content might be public available.

The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded. By using this website or any of our products' sales services you are waiving the use of a jury trial or a class actions.
